Scenario 1:
You join this group to shoot a model. You pay the model for her time. You post her pictures in your website (flickr, PBase, whatever) and somebody offers to buy prints for some of the images. No release form signed.
Questions:
What are the legal issues with regards to this?
Do you have to pay the model commission?
Do you have to inform the model of the sale?

yes i think you have to talk to the model.. coz first of all...
most group photoshoots of models are just for fun/practice
..or a contract could be prepared =) para claro lahat.. and i think it would be unfair for the model if you earn from the photos tapos sya wala ..
am i making sens?

If ever my pic of the model gets an offer, I'd inform the model. That's the right thing to do, I'll just take her out for dinner. Hehehe :)

If this happens, make the release form asap and have her sign it...even if it is after the shoot. You paid her so I dont think that she will say no to signing the release form. The models release must be specific what you may and may not use the image for. If she refuses to sign the release form, then you may want to inform her that someone is interested in purchasing the images and that you will give her a cut...the bargaining depends on the both of you. She may demand 50-50 or less...whatever it is, you will have to respect her decision and put everything into writing and have a formal contract made. Either way, if it happened to me as a photographer, I would automatically give the model a cut. Models release or no models release......but thats just me.

doc,one more thing models here in sg are under agency they are not allowed to do direct business w photographers.

I suggest you ask models to sign models' releases during the shoot, not only when there is opportunity to sell rights to the photos. But if you have not, then this is the time to do it.

So i should have a model release form to all shoots that i attend? Whether paid or unpaid? Workshop or fun shoots? I'm confused, i have never let any model sign a release form in all of my shoots whether paid or unpaid. Ok i guess a release form is a must then. Thanks.

I agree that models should be entitled to a share of what photographers earn, either as a fixed sum paid in advance during the shoot, or as a defined percentage of earnings every time the photographer sells licenses to use the photographs. The contract between them should include terms of payment.
